Guatemalan national charged after allegedly assaulting federal officer during immigration arrest

Roberto Carlos Munoz, a 39-year-old Guatemalan national, faces federal charges for assaulting a federal officer with a deadly weapon. The incident occurred during an attempt to execute an immigration arrest warrant due to Munoz's illegal status in the United States. Acting U.S. Attorney Joseph H. Thompson announced the charges.

Court documents reveal that Munoz was convicted of Fourth-Degree Criminal Sexual Conduct in December 2022 after being charged with sexually abusing a minor. Despite an Immigration and Customs Enforcement (ICE) detainer issued at his arrest, local authorities released him from custody.

On June 17, 2025, federal officers attempted to arrest Munoz during a traffic stop. He refused to comply with commands to lower his windows or open his car door. An ERO Officer broke a window using a spring-loaded punch to unlock the door when Munoz put the vehicle in drive, dragging the officer along as he accelerated onto the curb.

The officer's arm was caught in the window as Munoz drove erratically for about 100 yards before the officer was dislodged from the car upon reentering the street. The officer sustained significant injuries requiring medical treatment.

Acting U.S. Attorney Thompson stated, "Law enforcement officers deserve our respect, our gratitude, and our protection." He emphasized zero tolerance for violence against law enforcement personnel.

FBI Minneapolis Special Agent in Charge Alvin M. Winston Sr. commented on Munoz's lack of legal right to be in the country and his violent resistance during the lawful immigration arrest attempt. "The FBI takes any assault on a federal officer with utmost seriousness," he said.

Peter Berg, ICE ERO Field Office Director for St. Paul, described Munoz's actions as "a brazen and cowardly act by a criminal illegal alien."

The investigation involved collaboration between the FBI, ERO, and HSI agencies, with Assistant U.S. Attorney Raphael B. Coburn prosecuting the case.

It is important to note that all defendants are presumed innocent until proven guilty beyond reasonable doubt in court.
