The New House Republican Caucus has issued a statement in regards to their lawsuit against Gov. Tim Walz. | Facebook
The New House Republican Caucus' (NHRC) lawsuit against Gov. Tim Walz, stating that his use of peacetime emergency powers has been unconstitutional, has been heard in court.
The statement from the NHRC reiterated that 11 other states have already found their governor's lawmaking authority in this time of disaster unconstitutional.
"This case is not about politics, or even the virus," the statement reads. "This case is about our constitution and the balance of power in our state."
The group said that it is important for all three branches of government to be considered equal and provide checks and balances "to safeguard against oppression and the consolidation of power."
"No governor, no matter if he or she is Republican or Democrat, should be able to unilaterally write laws for an indefinite period of time without legislative oversight or judicial review," the statement reads. "It is imperative our process be fair and just no matter which party controls the executive branch, the House, or the Senate.”
The judge will issue his ruling in several weeks.
The NHRC is led by Rep. Steve Drazkowski and includes Rep. Carl Bahr, Rep. Tim Miller and Rep. Jerry Munson.
