Notice of Concurrent Public Hearing: City Council, City, Board of Commissioners of the Port Authority

NOTICE IS HEREBY GIVEN that the City Council (the “Council”) of the City of Bloomington (the “City”) and the Board of Commissioners (the “Board”) of the Port Authority of the City of Bloomington (the “Port Authority”) will hold a concurrent public hearing on Thursday, October 29, 2020, at or after 6:00 p.m. at City Hall, 1800 West Old Shakopee Road in the City, with respect to (i) a business subsidy to be provided by the City and the Port Authority to SICK, Inc, a Minnesota corporation, or any of its affiliates (collectively, the “Developer”), pursuant to Minnesota Statutes, Sections 116J.993 to 116J.995, as amended (the “Business Subsidy Act”); and (ii) an Ordinance approving the conveyance to the Developer, by limited warranty deed, of all or a portion of the real property located within Industrial Development District No. 1 – South Loop District and owned by the City (the “Development Property”), legally described as:

Lot 1, Block 1, BIRD & CRONIN ADDITION, Hennepin County, Minnesota.

Lot 1, Block 1, R.E. MURRAY 1ST ADDITION, Hennepin County, Minnesota.

Lot 2, Block 1, ALPHA BUSINESS CENTER, Hennepin County, Minnesota.

The East 302.71 feet of the following described tract:  All of the Southwest ¼ of the Northeast ¼ of Section 1, Township 27, Range 24 West of the 4th P.M. except the South 26 acres thereof, Hennepin County, Minnesota

The City is conveying the Development Property to the Developer for the purpose of the construction in multiple phases of approximately 170,000 to 215,000 square feet of production and logistics space, approximately 200,000 to 300,000 square feet of office space, approximately 30,000 to 60,000 square feet of warehouse space, parking, and utilities, including storm water management facilities, on the Development Property (the “Minimum Improvements”). 

The purpose of the proposed business subsidy is to aid the Developer in the construction of the Minimum Improvements.  Information concerning the proposed project, including the form of the business subsidy agreement to be completed for each phase of the Minimum Improvements, is on file and available for public inspection at the offices of the Administrator of the Port Authority and the Community Development Director of the City at City Hall.

Copies of the proposed development agreement setting forth the terms and conditions of the sale of the Development Property are on file and available for public inspection at the offices of the Administrator of the Port Authority and the Community Development Director of the City at City Hall.

Any person with a residence in the City or who is the owner of taxable property in the City may file a written complaint with the City and the Port Authority if the City or the Port Authority fails to comply with the Business Subsidy Act.  No action may be filed against the City or the Port Authority for the failure to comply unless a written complaint is filed.

At the time and place fixed for the public hearing, the City Council will give all persons who appear at the hearing an opportunity to express their views with respect to the proposal.  Written comments will be considered if submitted to the Administrator of the Port Authority at Bloomington Civic Plaza, 1800 West Old Shakopee Road, Bloomington, Minnesota 55431, on or before the date of the public hearing.
